The state and federal law of ethics is contained in a growing body of statutes, court decisions, and industry best-practice benchmarks, including the Federal Sentencing Guideliines, Sarbanes-Oxley, the Federal Acquisition Regulation, Title VII and Title IX of the Civil Rights Act, state workplace harassment laws (e.g., California’s AB 1825), In re Caremark, Faragher v. City of Boca Raton, the Foreign Corrupt Practices Act, the False Claims Act, and more. Prevent Fraud & Misconduct
The big three of ethics-related enterprise risks are (a) workplace harassment and discrimination, (b) fraud, theft, and corruption, and (c) abuse of discretionary power and authority. These three drain money, motivation, employee engagement, and other resources from organizations, leading to direct financial losses and impaired operation of the company. Harassment, fraud, and abuse are silent and unseen enterprise killers, much like high blood pressure, bad cholesterol, and inflamation are to the human body.
